The 5.6-week rule

Almost all UK workers are entitled to 5.6 weeks of paid leave a year. For someone on fixed days that is 5.6 × days per week — 28 days for a 5-day week, 16.8 days for 3 days — capped at 28 days. Employers may include bank holidays within the 5.6 weeks.

For irregular-hours and part-year workers, leave accrues at 12.07% of hours worked in each pay period (5.6 ÷ 46.4 working weeks), and rolled-up holiday pay is permitted.

Assumptions

  • Fixed days: days per week × 5.6, capped at 28, pro-rated by months worked.
  • Irregular hours: 12.07% of hours worked.

Worked example

3 days a week, started 4 months into the leave year

Full year: 3 × 5.6 = 16.8 days. Pro-rata for 8 months: 16.8 × 8/12 = 11.2 days.

Frequently asked questions

Are bank holidays extra?

Not by law — the 5.6 weeks can include them. Check your contract; many employers give 20 days plus bank holidays, which equals 28.

Can unused leave be carried over?

Generally only with agreement, or where you couldn't take it due to sickness or family leave; the rules changed in 2024 so check current guidance.

Do zero-hours workers get holiday?

Yes — 12.07% of hours worked, paid either as leave taken or as rolled-up holiday pay shown separately on the payslip.

How much holiday for a 4-day week?

4 × 5.6 = 22.4 days a year, which may include bank holidays.

What is rolled-up holiday pay?

For irregular-hours workers, an extra 12.07% added to each payslip instead of paid time off, shown as a separate line.
