In short

A Saudi final settlement adds the end-of-service benefit (half a month's wage per year for five years, a full month after; one-third, two-thirds or full on resignation by length of service), encashment of untaken leave at wage ÷ 30 per day, unpaid salary days and any notice pay in lieu, less unserved notice and debts — payable within one week (termination) or two weeks (resignation) under Article 88.

Who this is for: Employees leaving a job in Saudi Arabia and HR teams preparing the end-of-service settlement.

Not tax or legal advice. Based on the Saudi Labor Law minimums; contracts, company policy and court practice on the definition of 'wage' can change the figure. Confirm large settlements with the Labour Office or a lawyer.

What a Saudi final settlement includes

  • End-of-service benefit (Art. 84): half a month's wage for each of the first five years and a full month's wage for each year after, pro-rated for part years, on the last wage. On resignation (Art. 85): nothing under 2 years, one-third from 2 to 5 years, two-thirds from 5 to 10, full after 10. Full award regardless of years if the worker leaves under Art. 81 (employer breach), or a woman resigns within 6 months of marriage or 3 months of childbirth (Art. 87).
  • Leave encashment (Art. 111): all accrued, untaken annual leave at the daily wage (monthly ÷ 30).
  • Unpaid salary for days worked in the final month.
  • Notice (Art. 75): 60 days for monthly-paid staff on indefinite contracts (30 otherwise); whichever party fails to give notice owes the wage for the period. Fixed-term contracts end without notice on expiry.
  • Deductions: loans and advances, housing or car provided under the contract, and amounts ordered by a court — capped so that deductions do not exceed half the wage except for debts to the employer.

The settlement must be paid within one week (employer termination) or two weeks (resignation) of the contract ending (Art. 88).

Assumptions

  • EOSB from the Saudi rules file: ½ month × min(years, 5) + 1 month × years beyond 5, on the last wage; resignation fractions 0 / ⅓ / ⅔ / 1 by band; full on employer termination or Art. 81/87 exits.
  • Leave, unpaid salary and notice at wage ÷ 30 per day.
  • Deductions and unserved notice subtracted; GOSI and end-of-service for domestic workers not modelled.

Worked example

SAR 8,000 wage, 7 years' service, resigned, 14 leave days, 10 unpaid days

Full award = 8,000 × ½ × 5 + 8,000 × 2 = SAR 36,000. Resignation after 5–10 years → two-thirds = SAR 24,000.
Leave 14 × 266.67 = SAR 3,733; unpaid salary 10 × 266.67 = SAR 2,667. Net settlement ≈ SAR 30,400 with notice served and no deductions. Had the employer terminated, the EOSB alone would be SAR 36,000.

Frequently asked questions

Is EOSB calculated on basic or full salary?

On the 'wage', which the Labor Law defines as basic salary plus all fixed allowances (housing, transport) and regular commissions — not on basic alone, unless the contract defines a higher figure.

Do I lose EOSB if I resign?

Partly, unless you have 10+ years: nothing under 2 years, one-third from 2–5 years, two-thirds from 5–10 years. Expiry of a fixed-term contract counts as termination, not resignation, so the full award is due.

Can the employer hold my settlement until I leave the Kingdom?

No — payment is due within one or two weeks of the contract ending. Complaints go to the Labour Office, then the Labour Court, with no fees for the worker.

Are unpaid overtime and bonuses included?

Any earned but unpaid amounts are added; include them in the unpaid-salary line or deductions as appropriate.

How is end of service calculated in Saudi Arabia?

Half a month's wage per year for the first five years and a full month per year after, pro rata, on the last wage; reduced to one-third (2–5 years) or two-thirds (5–10 years) on resignation, full after 10.

When must the final settlement be paid in Saudi Arabia?

Within one week of the contract ending if the employer terminated it, or within two weeks if the worker resigned (Art. 88).
