In short
For 2025–2028, workers in tipped occupations can deduct up to $25,000 of reported qualified tips from federal income tax, whether or not they itemize; the deduction shrinks by $100 for every $1,000 of modified AGI above $150,000 ($300,000 joint). Tips still owe Social Security and Medicare tax (7.65%) and usually state income tax, and mandatory service charges do not count.
Who this is for: US servers, bartenders, drivers, stylists and other tipped workers estimating the 2025–2028 tips deduction.
How the no-tax-on-tips deduction works
- What it is: a federal income-tax deduction of up to $25,000 a year for qualified tips, available for tax years 2025–2028 whether you itemise or not. It is not an exemption from payroll tax — Social Security and Medicare (7.65%) still come out of every tip.
- Phase-out: the deduction shrinks by $100 for every $1,000 of modified AGI above $150,000 ($300,000 on a joint return), so a server deducting the full $25,000 loses it entirely at $400,000 of MAGI.
- Who qualifies: workers in occupations that "customarily and regularly" received tips before 2025 — Treasury published the list (food service, beverage, hospitality, personal care, transportation, entertainment, home services). Specified service trades (law, accounting, health, finance) are excluded.
- Self-employed: the deduction cannot exceed the net income of the business the tips came from.
- Paperwork: tips must be reported (W-2, 1099-NEC/K, or Form 4137). Unreported cash tips do not qualify — reporting them now has a payoff.
- Refund impact: withholding tables were not changed for 2025, so most tipped workers see the benefit as a larger refund when they file.

Assumptions
- Deduction = min(tips, $25,000), limited to the business's net income if self-employed.
- Reduced by $100 for each $1,000 (or part) of MAGI above $150,000 ($300,000 joint).
- Tax saved from the 2026 brackets after the standard deduction; FICA shown at 7.65%.
Worked example
MAGI $50,000 — well under the $150,000 phase-out, so the full $18,000 is deductible. Taxable income falls from $33,900 to $15,900; federal tax falls from $3,820 to $1,660, a saving of about $2,160 (12% of the deduction). FICA of $1,377 on the tips is still owed. The deduction would only start shrinking above $150,000 of MAGI and vanish at $330,000.
Frequently asked questions
Are tips really tax-free now?
Only from federal income tax, up to $25,000 a year and only for 2025–2028. Social Security, Medicare and most state income taxes still apply.
Which jobs qualify?
Treasury listed about 70 occupations — servers, bartenders, baristas, delivery and rideshare drivers, hotel and casino staff, hairdressers, barbers, nail technicians, massage therapists, musicians, golf caddies and more.
Do service charges count?
No. Automatic gratuities and mandatory service charges are wages, not tips. Only voluntary amounts the customer decides count.
Do I have to itemise?
No — it is an above-the-line style deduction on Schedule 1-A, available with the standard deduction.
Do I still report my tips?
Yes — only reported tips qualify. The deduction is figured from the W-2, 1099 or Form 4137 amounts, so under-reporting now costs you the deduction.
Does the deduction reduce state tax?
Only in states that conform to the federal change; several high-tax states have decoupled, so check your state return.
