UAE overtime rates under the 2021 Labour Law

  • Normal overtime: basic hourly wage + 25% (Art. 19).
  • Overtime between 10pm and 4am: basic hourly wage + 50% (does not apply to shift workers).
  • Work on the weekly rest day: either a substitute day off, or basic hourly wage + 50% (Art. 21).

The hourly wage is commonly calculated as basic monthly salary ÷ 30 ÷ 8. Overtime is generally capped at 2 hours per day unless the work is needed to prevent substantial loss or a serious accident. Certain senior/managerial roles are excluded from overtime entitlement altogether.

Basic AED 6,000, 10 normal overtime hours

Hourly wage = 6,000 ÷ 30 ÷ 8 = AED 25.00
Overtime = 10 × 25 × 1.25 = AED 312.50

Frequently asked questions

Is overtime calculated on basic or total salary?

On basic wage, per the law's wording — though some employment contracts specify a more generous basis. Check yours.

Are managers entitled to overtime?

Employees in supervisory/managerial positions with authority over others are generally excluded, as are some other categories set out in the executive regulations.

Does this handle Ramadan hours?

No — during Ramadan, working hours are reduced by 2 hours/day, which lowers the threshold at which overtime starts. Adjust your hours accordingly.

Can my employer refuse to pay overtime?

Not for eligible employees; overtime is a statutory entitlement. Managerial and supervisory roles listed in the executive regulations are excluded.

How is overtime calculated for shift workers?

Shift workers on rotating patterns do not get the extra night premium; the standard 125% rate applies to their overtime.
